1. Agreement to Terms
These Terms of Service ("Terms") are an agreement between you and Lound ("we," "us," or "our") regarding your use of the Lound mobile app and related services (the "Service").
By creating an account or using Lound, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Service.
2. Eligibility
You must be at least 13 years old (or 16 in the EU) to use Lound. By using the Service, you confirm that:
- You meet the minimum age requirement
- You can enter into a legally binding agreement
- You'll follow these Terms and applicable laws
- The information you provide is accurate
3. Your Account
3.1 Creating an Account
You can sign up with email/password, Google, or Apple ID.
3.2 Keeping It Secure
You're responsible for:
- Keeping your login credentials safe
- Everything that happens under your account
- Letting us know immediately if someone gains unauthorized access
4. What Lound Does
Lound is a voice journaling app that:
- Records and transcribes your voice memos
- Uses AI to analyze your thoughts and provide insights
- Generates mood assessments, themes, and personalized reflections
- Tracks your journaling streaks
- Provides personalized check-in questions
5. Subscriptions and Payments
5.1 Free and Pro Tiers
- Free: Basic features with some limitations
- Pro: Full access to all features, advanced AI analysis, unlimited recordings
5.2 Pricing
- Annual: $99.99/year
- Quarterly: $49.99/quarter
Prices may change. We'll give you notice before any price increases.
5.3 Free Trial
New users get a 30-day Pro experience when signing up, plus an optional 7-day free trial after that. If you don't cancel before the trial ends, you'll be charged automatically.
5.4 Auto-Renewal
Subscriptions renew automatically. You'll be charged through Apple or Google at the start of each billing period unless you cancel first.
5.5 Cancellation
- Cancel anytime through your App Store or Google Play account settings
- You'll keep access until the end of your current billing period
- No refunds for partial periods (except as required by law)
- Refund requests go through Apple or Google since they process payments
6. Using Lound
6.1 What You Can Do
We grant you a limited, personal, non-transferable license to use Lound for your own journaling purposes.
6.2 What You Can't Do
Please don't:
- Use Lound for anything illegal
- Try to hack, reverse engineer, or break into the system
- Use bots or automated tools to access the Service
- Impersonate others or collect information about other users
- Interfere with the Service or overload our servers
6.3 Content Guidelines
Your journal is private, but please don't record content that:
- Violates laws
- Contains threats of violence
- Infringes on others' intellectual property
- Contains child sexual abuse material
7. Your Content
7.1 You Own It
Your voice recordings, transcriptions, and journal entries belong to you.
7.2 License to Us
By using Lound, you give us permission to:
- Store and process your content to provide the Service
- Send your audio to AssemblyAI for transcription
- Send your transcriptions to OpenAI for analysis
- Use anonymized, aggregated data to improve the product
We won't share your identifiable content with third parties except as described in our Privacy Policy.
7.3 Our Intellectual Property
Lound's design, features, and code are ours. You can't copy or use them without permission.
7.4 Feedback
If you share ideas or suggestions with us, we can use them without owing you anything. (But we appreciate the feedback!)
8. AI-Generated Content
8.1 What AI Does
Lound uses AI to analyze your journal entries and generate:
- Mood assessments and emotional patterns
- Themes and insights
- Personalized reflections and questions
8.2 AI Isn't Perfect
AI-generated content may not always be accurate. Please understand that:
- AI analysis is for reflection purposes only
- It's not professional advice of any kind
- Lound is not a substitute for therapy or medical care
- Don't rely solely on AI insights for important decisions
8.3 Not Medical Advice
Lound is a journaling tool, not a medical device. It doesn't provide medical advice, diagnosis, or treatment. If you're struggling with your mental health, please reach out to a qualified professional.
9. How We Handle Your Data
9.1 What Happens to Your Audio
When you record a voice memo:
- The audio is sent to our server
- We forward it to AssemblyAI for transcription
- The audio is processed in memory only - we never store audio files on our servers
- Only the text transcription is saved
9.2 Audio Isn't End-to-End Encrypted
Important: While we use encryption in transit, your recordings are not end-to-end encrypted. They're sent to third-party services for processing. If you need end-to-end encryption, Lound isn't the right fit.
9.3 Security
We use industry-standard security measures, but no system is completely secure. You use Lound at your own risk.

10. Account Termination
10.1 You Can Leave Anytime
Delete your account through the app settings. This permanently removes:
- All transcriptions and AI analysis
- Your profile and account data
- Usage history
(Remember: we never stored your audio files anyway.)
10.2 We Can Terminate Your Account
We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraud or illegal activity
- Your account poses a security risk
- We're required to by law
- We discontinue the Service (with reasonable notice)
11. Disclaimers
11.1 "As Is" Service
LOUND IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We don't guarantee that:
- The Service will always be available or error-free
- AI analysis will be accurate or reliable
- The Service will meet all your expectations
11.2 Limitation of Liability
TO THE MAXIMUM EXTENT ALLOWED BY LAW, LOUND ISN'T LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING:
- Lost profits or data
- Unauthorized access to your data
- Errors in AI-generated content
- Service interruptions
11.3 Liability Cap
Our total liability is limited to the amount you paid us in the 12 months before your claim, or $100, whichever is greater.
11.4 Some Places Don't Allow These Limits
Some jurisdictions don't allow limitation of certain warranties or liability. If that applies to you, some of these limitations may not apply.
12. Indemnification
You agree to protect us from any claims arising from your use of Lound, your content, or your violation of these Terms.
13. Disputes
13.1 Governing Law
These Terms are governed by the laws of New York, USA.
13.2 Arbitration
Most disputes will be resolved through binding arbitration under AAA Consumer Arbitration Rules, not in court. Exceptions:
- You can use small claims court if your claim qualifies
- Either of us can seek emergency relief in court for intellectual property issues
13.3 No Class Actions
Disputes will be resolved individually. You waive the right to participate in class action lawsuits or class arbitration.
13.4 You Can Opt Out
If you don't want to be bound by the arbitration clause, email [email protected] within 30 days of accepting these Terms.
13.5 If You're in the EU, UK, or Similar Jurisdictions
If you're in a jurisdiction where this arbitration clause isn't enforceable (like the EU, UK, or Canada), it won't apply to you. Instead, disputes will be resolved in your local courts as required by your local consumer protection laws.
14. Copyright Complaints
If you believe content on Lound infringes your copyright, email [email protected] with:
- A description of the copyrighted work
- Where the infringing material is located
- Your contact information
- A statement that you believe the use isn't authorized
- A statement that the information is accurate (under penalty of perjury)
We'll respond to valid complaints promptly.
15. Changes to These Terms
We may update these Terms. When we make significant changes:
- We'll update the "Last Updated" date
- We'll notify you through the app or by email
Continuing to use Lound after changes means you accept the updated Terms.
16. Changes to the Service
We can:
- Add, modify, or remove features
- Change pricing (with notice)
- Discontinue the Service (with reasonable notice)
17. General Terms
17.1 Entire Agreement
These Terms and our Privacy Policy are the complete agreement between us.
17.2 Severability
If any part of these Terms is unenforceable, the rest still applies.
17.3 No Waiver
If we don't enforce something once, that doesn't mean we've waived our right to enforce it later.
17.4 Assignment
You can't transfer your account or these Terms to someone else. We can.
17.5 Force Majeure
We're not liable for things outside our control (natural disasters, war, etc.).
17.6 Third-Party Services
We rely on services like AssemblyAI and OpenAI. We're not responsible for their availability or accuracy.
18. App Store Terms
18.1 Apple App Store
If you downloaded from Apple:
- This agreement is between you and Lound, not Apple
- Apple isn't responsible for support or claims about the app
- You must also comply with Apple's App Store Terms
18.2 Google Play Store
If you downloaded from Google Play:
- This agreement is between you and Lound, not Google
- Google isn't responsible for support or claims about the app
- You must also comply with Google Play's Terms
